• In accordance with art. 18 GDPR, you have the right to request the restriction of processing of your personal data if you contest the accuracy of the personal data, if the processing is unlawful but you oppose its deletion or if we no longer need the data, but  you require it for the establishment, exercise or defense of legal claims, or you have objected to the processing pursuant to art. 21 GDPR.

   We use the commonly used SSL encryption (Secure Socket Layer) with the highest level of encryption supported by your browser. This is generally 256 bit encryption. SMT Scharf AG processes the following categories of your personal data for shareholder matters: Contact details (e.g. name or email address), information regarding your shares (e.g. number of shares, type of shares) and information regarding general meetings (e.g. the list of attendees of the general meeting which will contain your name, should you wish to participate).

SMT Scharf AG only processes personal data in order to meet its statutory obligations under the German Stock Corporations Act and other laws. This data processing is permissible pursuant to art. 6(1)(c) of the General Data Protection Regulation (GDPR).

Personal data relating to you are, as a rule, not passed on to third parties. As an exception, third parties may be provided with access to this information if they are engaged by SMT Scharf AG to perform shareholder-related services. For example, auditors, lawyers, investor relations advisors and general meeting agencies. These service providers only receive personal data to the extent that it is necessary for the performance of their services.

The aforementioned data will be deleted as soon as they are no longer necessary for the performance of statutory obligations, to the extent that there is not a statutory retention period. The list of attendees for a general meeting is deleted two years after the end of the general meeting.

You have the right to receive, free of charge, information regarding the personal data relating to you that we have stored. In addition to this, you have the right to the correction of inaccurate data, the right to request a restriction of processing of excessively processed data and the right to the deletion of personal data being processed unlawfully or stored for too long (to the extent that this would not be inconsistent with a statutory retention period or any of the provisions of art. 17(3) of the GDPR).
